By accessing or using RoutineXAI (“the Service”), operated by RoutineXAI (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Description of Service

RoutineXAI is an AI-powered platform that generates personalized daily routines based on user-defined goals, preferences, and schedule constraints. The Service includes routine generation, progress tracking, streak analytics, AI coaching, and related features.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained consent from a parent or legal guardian.

4. User Accounts

To access certain features, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security and confidentiality of your password
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for more than 12 months.

5. AI-Generated Content Disclaimer

The routines, schedules, and recommendations generated by RoutineXAI are produced by artificial intelligence and are provided for informational and general wellness purposes only.

AI-generated content on this platform:

Is not medical advice. Routines involving exercise, nutrition, weight loss, or physical activity do not constitute medical, dietary, or professional health advice. Always consult a licensed physician, dietitian, or qualified healthcare professional before starting any new exercise program, diet, or wellness regimen — especially if you have pre-existing health conditions, injuries, or are pregnant.
Is not guaranteed to be accurate. AI models may produce errors, hallucinations, or inappropriate suggestions. We do not warrant the accuracy, completeness, reliability, or suitability of any AI-generated content.
Should be used at your own risk. You are solely responsible for evaluating the appropriateness of any routine or recommendation before acting on it. We disclaim all liability for any injury, damage, or loss resulting from your reliance on AI-generated content.
May not account for individual circumstances. While we strive for personalization, AI cannot fully assess your unique medical history, physical limitations, allergies, or mental health needs.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the Service or its infrastructure
Use automated scripts, bots, or scrapers to access the Service without our written consent

7. Intellectual Property

The Service, including its design, code, logos, trademarks, and all non-user content, is the property of RoutineXAI and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

Your content: You retain ownership of the personal data and goals you submit. By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing and improving the Service.

AI-generated routines: Routines generated for you are licensed to you for personal, non-commercial use. You may not commercially redistribute AI-generated routines without our written permission.

8. Fees and Billing

RoutineXAI currently offers a free tier. If we introduce paid plans in the future, we will notify you in advance. Paid features, if applicable, will be clearly disclosed before purchase. You will not be charged without explicit consent.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROUTINEXAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service
Any personal injury, illness, or health-related harm resulting from following AI-generated routines, exercises, diet suggestions, or wellness recommendations
Any loss of data, revenue, profits, or business opportunities
Any errors, inaccuracies, or omissions in AI-generated content
Any unauthorized access to, or alteration of, your data or transmissions

In no event shall our total aggregate liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless RoutineXAI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Your reliance on AI-generated content without seeking professional advice
Any content you submit to the Service

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, error-free, or secure
AI-generated results will be accurate, complete, or suitable for your needs
Any defects in the Service will be corrected
The Service will meet your specific requirements or expectations

12. Termination

You may stop using the Service at any time. You may request deletion of your account and associated data by contacting us at legal@routinexai.com.

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, in accordance with our Privacy Policy.

13. Third-Party Services

The Service may integrate with or rely on third-party services, including AI model providers (e.g., Together AI, OpenAI) and hosting providers (e.g., Vercel, Railway, Neon). We are not responsible for the practices, policies, or availability of third-party services. Your use of such services is subject to their respective terms and privacy policies.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RoutineXAI regarding the use of the Service and supersede all prior agreements and understandings.
